ALTA ENDORSEMENTS - 270 - SAMPLES AND DESCRIPTIONS WATER–BUILDINGS – FORM 41-06 This endorsement provides insurance with respect to damage to existing improvements because of “use of the surface for extraction or development of water” and is intended for use in some western States. This endorsement insures against loss or damage “by reason of the enforced removal or alteration of any Improvement resulting from the future exercise of any right existing at Date of Policy to use the surface of the Land for the extraction or development of water excepted from the description of the Land or excepted in Schedule B.” The endorsement does not insure against adverse ownership of such water rights or insure title to water.
