ALTA ENDORSEMENTS - 50 - SAMPLES AND DESCRIPTIONS COVENANTS, CONDITIONS AND RESTRICTIONS – UNIMPROVED LAND – OWNER’S – FORM 9.1-06 ALTA Endorsement – Form 9.1-06 is available for an owner’s policy only. This endorsement introduces the most visible change from the previous ALTA 9 series. The encroachment and mineral coverages have been deleted, so the endorsement covers only covenant, condition and restriction issues. The encroachment coverages previously given here are now available in the ALTA 28 series and minerals coverage in the new ALTA 35 series. The covenant, condition and restriction coverages parallel the new style introduced in the ALTA 9 above, for those that apply to ownership of unimproved land. Section 4 of the Form 9.1-06 excepts Covenants in a lease, Covenants creating obligations to maintain, repair or remediate the Land, and Covenants “relating to environmental protection of any kind or nature, including hazardous or toxic matters, conditions, or substances.” ALTA Endorsement — Form 9.1-06 (Covenants, Conditions and Restrictions – Unimproved Land – Owner’s – 4/2/12) Form 9.1-06 Covenants, Conditions and Restrictions – Unimproved Land – Owner’s
